The www.oggi-paris.com site online store, has been developed by the OGGI company, who is the operator of this site. Any order placed from this online Web store www.oggi-paris.com requires the consultation of the hereunder general terms and conditions.
Consequently, the customers recognize that they are perfectly informed of the fact that their agreement, concerning the contents of the present general terms and conditions, does not require the hand-written signature of this document, while ordering products from this web site shop.
The customer has the power to save or edit the present general terms and conditions, keeping in mind, that saving or editing this document, will be under their total responsibility.
The online shop, developed by the OGGI Company, within the framework of the web site, mentions the following information:
1. Legal information, allowing a precise identification of the OGGI company,
2. Specifications of the essential characteristics of the online products proposed,
3. Prices in Euros of all the products, as well as the delivery cost, if applicable,
4. Payment terms, delivery window, or manufacturing,
5. The existence of a right of retraction,
6. The duration of validity of the offer or the price,
7. The conditions of termination of the contract, when this one is in indefinite duration or of more than one-year duration,
8. All this information is both in French and English. The customer declares to have the full legal capacity allowing him to make a commitment in conformity with the terms and conditions.
Article 1 – Integration clause
The present general conditions express the totality of the obligations of both parties. Therefore, the customer is accepting without any reluctance, all the terms and conditions, specified in this document. No general or specific conditions, appearing in documents, sent or handed by the customer, can become integrated into the present, since these documents would be incompatible with these general conditions.
In the hypothesis that one of the clauses of the present contract would be invalid by a change of legislation, regulations or by a decision of justice, it would not affect the validity and the respect of the present general conditions of sale.
Article 2 – Object
Those general conditions have for object to define the rights and duties of the both parties within the framework of the online sale of products and the services proposed by the company OGGI to the customer.
The present general conditions of sale apply between:

Hereafter “customer”
The present conditions aim at defining the modalities of remote sale between OGGI and the customer, from the order, the payment and the delivery. They settle all the different steps necessary for the placement of the order and the follow-up of this order between the contracting parties.
The order implies the irrevocable commitment to the general conditions of sale. These general conditions of sale are subject to modifications; the applicable conditions are the ones current on www.oggi-paris.com, at time of the placement of the order of the customer.
The customer declares:
– having the capacity to fulfil the present contract, having reached the legal majority and not being under guardianship,
– not to make purchases of OGGI’s products with the intention of reselling them.
Article 3 – Coming into effect – duration
The present general conditions come into effect at the date of the order confirmation.
The present general conditions are concluded for the duration necessary for the supply of goods and the signed services, until the extinction of guarantees owed by the company OGGI
The present conditions apply during the duration of the online publishing of the services offered by OGGI.
Article 4 – Products information.
Products proposed for sale by OGGI are the ones showed on the www.oggi-paris.com site, the day customer visited the OGGI’s web site.
Products proposed for sale, are described and presented in a way as close as possible to reality and allow to respect the Article L 111-1 of the Code of the consumption, which foresees the possibility for the potential consumer of knowing, before the placement of the final order, the essential characteristics of the products which he wishes to buy.
However, if errors or omissions should occur in this description, the responsibility of OGGI could not be engaged. Photos and texts, illustrating products, have only an indicative value and do not enter the contractual field. Products are proposed on sale until stocks last.
Article 5 – Prices
5.1 – The prices are in euros (€) HT exclusive of tax (except European Community) and TTC Inclusive of all taxes including the VAT (European Community) and except the cost of delivery, which is chargeable to the customer (except any specific mention or particular conditions) and indicated before the validation of the order.
The indicated prices take into account the applicable VAT at the day of the order. If the rate of VAT came to be modified, these changes could be applied to the price of articles without the customer being beforehand informed about it.
5.2 – The OGGI shop reserves the right to modify its prices at any time, but products will be charged based on the current price lists, at the time of the placement of the orders, subject to availability of products at this date.
5.3 – Products remain the property of the OGGI shop until complete receipt of payment of the products.
Article 6 – Orders

6.1 – Validation
IMPORTANT: the “click” of the customer in conformance with the order form constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.
When the customer clicks the button “Validate” after the process of the order, he declares to accept this as well as the totality of the present General Conditions of Sale completely and without reserve. The data recorded by the shop OGGI, are the proof of all the transactions made between the OGGI shop and its customers and are the only ones valid in case of litigation between the shop OGGI and its customer.
Any order is an irrevocable acceptance of the prices and the descriptions of products available for sale.
6.2 – Confirmation of order.
It is scheduled that, right after an order has been recorded, an e-mail is sent to the customer. This e-mail confirms that the order of the customer was taken into account by OGGI, and not the availability of the product itself.
6.3 – Cancellation of order
The OGGI shop reserves for itself the right to cancel any order of a customer with whom there would be a litigation regarding the payment of a previous order.
6.4 – Availability of products.
The order will be launched at the latest within 5 working days (in France only) this period starting the day after the day of placement of the order by customer. In case of unavailability of the product ordered, due to the suppliers, the customer will be informed about it as soon as possible, and will have the possibility of modifying or of cancelling his order. The customer will have then the choice to ask either for the refund of the sums paid, within 30 days at the latest from his payment, or the exchange of the product.
Article 7 – Payment
The payment of purchases can be made via PAYPAL or with the following bank cards:
Only the credit cards Visa, Mastercard, Amex and Aurore are accepted.
In the case of a payment by postal or banking check, the customer has to send a check of the amount including postal charges (if applicable) to the order of OGGI at the following address:

The customer will have to specify his/her NAME and the MAILING ADDRESS as well as his/her e-mail address so that OGGI sends and confirms the order.
For the international orders, checks are not accepted. The customer has the possibility of paying by swift transfer (from bank to bank).
In the case of a payment by check, the OGGI shop will proceed to the delivery after reception and payment of the Check.
The invoice of the product will be inserted into the parcel containing the ordered product.
Article 8 – Delivery
8.1-Terms of delivery and delivery charges
Products are delivered to the address indicated by the customer on the order form (basket) and mainly in Metropolitan France, French Overseas Departments, in the EEC, and internationally.
The customer should imperatively verify if the packaging is in good condition upon the delivery of the parcel, and notify the damage (if any) due to the carrier, on the delivery slip, as well as to the company OGGI, within one week. The customer can request the sending of an invoice at the billing address and not at the delivery address, by informing OGGI using the comment field provided for that purpose on the order form (basket).
8.2 – Delivery deadlines
Except the case of an act of god, the delivery time limits will be, while stocks last, those indicated below:
– France: available for delivery by post (colissimo, including insurance of the goods), delivery times 1 to 4 working days in France
EEC: available for delivery by post (colissimo, including insurance of the goods)
Out of EEC: available fo delivery by post (colissimo, including insurance of the goods)
OGGI maintains the right of choosing the carrier and guarantees safe shipping of products. In case of a delivery delay beyond the standard limit and exceeding seven days, and not in a case of an “act of god”, the customer can cancel his/her order.
8.3 – Problems of delivery – quality and conformity of products
At time of delivery, you have to double check the conformity of the goods, before signing the delivery slip. If any problems occur, please use this document, and specify by hand writing your comments regarding this issue (error of delivery, damage, missing products (according to the delivery slip), damaged parcel, and products broken…) and duly sign this document.
In this case, OGGI makes a commitment to reimburse or to exchange the products, that are not in conformity with your order (defective or not corresponding) after you made a claim, by specifying your address and phone number, invoice number, the references of the product, as written on the invoice, to OGGI, 10 rue du Chevalier St-George – 75001 Paris – FRANCE, by e-mail or telephone.
At the same time, the customer will have to confirm this claim, by sending to the carrier within the next two working days after the delivery date, a registered letter with acknowledgement of receipt, explaining the problem in detail.
The OGGI shop can ask you to return the products involved. In the case of return by carrier, the freight charges will be reimbursed, providing OGGI is sent the documents mentioning these expenses accordingly. However, the amount of reimbursement of the cost of return cannot exceed 1.5 times the amount of the initial freight cost as mentioned on the invoice.
For any return of merchandise, the return will be accepted and the exchange or refund done, only for complete products, being in their state of origin (packaging, accessories) with the original invoice.
8.4 – Returns and Exchanges
Should your OGGI piece(s) not meet your expectations, you have 14 days from the date of delivery to return the merchandise. After 14 days, the delivered items are considered as accepted by the customer and OGGI reserves the right to refuse exchanges, credits or refunds. You will be reimbursed for the cost of the merchandise within 14 days of receipt of the returned item(s).
The cost of sending and of return will remain at your expense.
The present right of return can be accepted only for the complete products, in their state of origin (packaging, accessories) with the original of the invoice. If the returned products are incomplete, damaged or dirtied by the Customer, they cannot be taken back.
No return against refund will be accepted for whatever reason.
The returned product has to be in its original packing with the original invoice
– either by mail to OGGI 10 rue du Chevalier St-George – 75001 Paris – France. The expenses of return are to be paid by the customer. In that case, an e-mail will be sent to the Internet user to inform him about the refund to be done by check or by bank card, according to the method of payment chosen at time of placement of the order.

8.5-Parcel not received
The customer has a deadline of 30 days after the date of the payment of his order to advise OGGI of any problem in receiving the parcel. Beyond this deadline, any complaint will be considered as unacceptable.
Article 9 – Intellectual property
All the parts of the www.oggi-paris.com site, visual or sound, all the texts, the comments, the works, the illustrations and the pictures are protected by the copyright and the trade marks worldwide. Therefore and according to the Code of the Intellectual property, they are the exclusive property of the company OGGI.
Article 10 – Responsibility
The responsibility of OGGI would not be involved for all the inconveniences or the damage inherent to the use of the Internet network, in particular a break of the service, an outside intervention or the presence of computer viruses, or any fact qualified as “act of god”, according to the case law.
Besides, OGGI does not take the responsibility for any negligence in its contractual obligations in the hypothesis of any facts qualified as “act of god” according to the case law.
The proposed products are in accordance with the current French legislation and with the applicable standards in France. The OGGI shop would not be considered as responsible in case of:
– products being out of stock or unavailability of the product,
– for “acts of god”, partial or total strikes (in particular in postal services, freight forwarder, trucker and\or communications…), flood, fire and in case of obvious error.

Article 11 – Guarantee and After-sales service
Products bought on “www.oggi-paris.com” give the right to a guarantee of 10  years.
After this deadline, the product can always be repairable.
To be able to benefit from the guarantee of products, it is necessary to keep the invoice of the product.
Guarantees do not cover:
– The defects and their consequences, due to incorrect use of the product or any use for which the product is not intended.
Article 12 – Applicable right – Disputes
The present general conditions of sale are subjected to the French legislation.
In the hypothesis of a dispute arising from the present contractual relation, the customer and OGGI makes a commitment before any legal action to look for an amicable solution. In case of dispute, only the courts of Paris (France) will be competent.
Article 13 – Protection of personal information – Name specific Information
The name specific information, collected within the framework of the remote sale is mandatory, this information being necessary for the processing and the delivery of the orders as well as for the issuing of invoices. This information is strictly confidential and is intended only for OGGI.
The OGGI shop makes a commitment not to reveal to third parties the information which you communicate to us. These are confidential. They will be used by its internal services only for the processing of your order.
